General Terms and Conditions of Sale

Article 1 — Purpose and scope

These General Terms and Conditions of Sale (GTCS) govern sales concluded on the website alphanco.be and all orders placed with ALPHA & CO BOUWMATERIALEN SRL (hereinafter "ALPHA&CO"), a company under Belgian law with registered office at Ninoofsesteenweg 77-79, 1700 Dilbeek, Belgium, registered with the Crossroads Bank for Enterprises under no. BE 1028.386.674.

Any order implies full and complete acceptance of these GTCS. ALPHA&CO reserves the right to modify its GTCS at any time; the applicable terms are those in force on the date of the order.

Article 2 — Products

The products offered for sale are those shown on the website, within the limits of available stock. Photographs, descriptions and specifications are provided for guidance only and do not engage the liability of ALPHA&CO in the event of minor changes by the manufacturer.

Article 3 — Prices

Prices are indicated in euros, all taxes included (Belgian VAT 21% except products subject to reduced VAT). Delivery charges are calculated and displayed before the order is validated. ALPHA&CO reserves the right to change its prices at any time, it being understood that the applicable price is the one in force at the time of the order.

Article 4 — Order

The order is validated after acceptance of the GTCS and confirmation of payment. A confirmation e-mail is sent to the customer. ALPHA&CO reserves the right to refuse any order for a legitimate reason (out of stock, non-payment, suspected fraud, etc.).

Article 5 — Payment

Payment is made online by bank card (Visa, Mastercard, Bancontact), Apple Pay, Google Pay, PayPal, Klarna (30 days) or SEPA transfer for pro accounts. All payments are secured with 3D Secure via our provider Stripe.

For B2B Pro accounts, payment at 30 days end of month is possible after validation of the AXA Belgium credit-insurance file.

Article 6 — Delivery

Orders are shipped from our Belgian warehouse (Ninoofsesteenweg 77-79, 1700 Dilbeek, Belgium) within 24 working hours, delivery within 24 to 72 hours in Belgium and Luxembourg, within 3 to 5 days in France. Times are indicative and may vary depending on carrier availability.

In the event of a delivery delay exceeding 7 working days beyond the announced time, the customer may request cancellation of the order and obtain a full refund.

Article 7 — Right of withdrawal

In accordance with article VI.47 of the Belgian Code of Economic Law, the consumer (excluding B2B Pro accounts) has a period of 30 calendar days from receipt of the product to exercise the right of withdrawal, without having to give a reason.

The product must be returned in its original packaging, unused. Return costs are borne by ALPHA&CO for Belgium and Luxembourg (DPD label provided). The refund is made within 14 days of receipt of the product at the warehouse, by the same means of payment.

Exclusions: custom-made products, cut to order, or unsealed (hygiene).

Article 8 — Warranties

All products benefit from the legal warranty of conformity (2 years minimum) in accordance with articles 1649bis to 1649octies of the Belgian Civil Code. Most of our products benefit from an extended manufacturer warranty (5 to 25 years depending on brand and category).

In the event of a defect, the customer must contact our after-sales service at [email protected] as soon as possible with photos/videos of the defect.

Article 9 — Liability

ALPHA&CO is responsible for the proper performance of the obligations arising from the contract. However, ALPHA&CO cannot be held liable for indirect damage (loss of operation, loss of opportunity, etc.), nor for damage resulting from misuse or non-compliant installation of the product.

Article 10 — Installation service

The installation service offered by ALPHA&CO is provided by a network of RGE-certified craftsmen, independent partners. The installation service benefits from a ten-year warranty and professional liability insurance. The specific conditions of the installation service are detailed in the signed quote.

The data collected is processed in accordance with the GDPR. See our privacy policy.

Article 12 — Disputes

These GTCS are governed by Belgian law. In the event of a dispute, the customer is invited to first contact customer service at [email protected]. Failing an amicable solution, the courts of Brussels have sole jurisdiction.

The consumer may also use the consumer dispute mediation service (consumerombudsman.be) or the European online dispute resolution platform (ec.europa.eu/consumers/odr).
